Selna in Santa Ana, California granted, Toyota moves to complaints of 41 applicants from countries in Asia, Europe, Australia and Central America, devalued, to sue the approval of claims that their vehicles were due to defects resulted that brought Toyota to recall laid off because millions of cars.
The judge ruled that the foreign plaintiffs did not have enough evidence to show that in the U.S. proceedings should be involved and that he made no jurisdiction over their claims. Selna said a lawyer for the plaintiffs that they are trying to change his mind is on some of its findings and said he was "skeptical" they would do in a position to be.
US-infringement lawsuits against Toyota economic loss, wrongful death or injury from sudden unintended acceleration were consolidated before Selna last April. The judge has lawyers that he wants to go the first cases to court in early 2013 told.
Toyota, the world's largest automaker calls, million U.S. vehicles last year and in 2009, most of them for defects, that unintended acceleration. It paid a record $ 48,800,000 in fines which were carried out some of the recalls. The automaker had in the past month that having regard to another 2.17 million vehicles in the U.S. for carpet and floor mat defects that could jam gas pedals.
Evidence
If the judge Toyota had refused to move, may be more applicants sought from abroad to the legal dispute bring into custody taking of evidence, including testimony from Toyota officials and access to secret source Toyota code for the electronic throttle control to join, have said Monica Kelly, the lawyer looking to bring proceedings in relation to foreign applicants.
Selna ruling party is all foreign applicants, the cars made in the USA, to join in the litigation if plaintiffs' lawyers for domestic cases allow them to make property, Kelly said after the hearing. She said two of the current plaintiffs produced their cars in the United States.
"Now we know that all foreign applicants, the US-made cars can only join the domestic dispute," she said.
Celeste Migliore, a spokeswoman for Toyota said the company believes Selna ruled correctly that the foreign plaintiffs have failed to meet the legal requirements, their claims against the company in a U.S. court to make.
"Basic problem"
"Although the court allowed the foreign plaintiffs the opportunity to try to supplement their complaint, we do not see as the fundamental problem is that these claims in the applicant countries of origin should be taken not to overcome in the U.S.," she said in an e-mail statement.
Toyotas are in at least 26 countries worldwide and market more than 170 corporations and sell Toyotas made in at least 170 countries, according to the statement.
